The engagement of the services of Abigail Badenhorst trading as AB Photography is subject to all the terms and conditions contained herein.

By booking a photography session or using our services, you agree to comply with these terms and conditions.
1.1. Booking confirmation Deposit:
To secure a booking for a photography session or event, a non-refundable deposit of 50% of the total agreed-upon fee is required. The deposit should be received by the photographer no later than one week before the scheduled date of the session or event. The photographer will consider the shoot as confirmed only upon receipt of the deposit. If the non-refundable 50% deposit is not paid one week before the shoot, your shoot is automatically deemed cancelled, unless an alternative explicit arrangement is agreed upon between the photographer and the client, in writing.
1.2. Payment deadlines:
The balance of the total fee, after the deposit, must be paid in full ion or before the day of the scheduled shoot, but must be paid before the session commences, failing which the shoot will not proceed.
1.3. Cancellation policy:
If the client wishes to cancel a confirmed booking, notice of such cancellation must be provided, in writing, to the Photographer. In the case of a cancellation within 3 days before the scheduled shoot, the client will be responsible for 20% of the total agreed-upon fee as a cancellation fee. Please note that the deposit has already been paid and the deposit is required one week before the shoot. In the event of cancellation by the client, the deposit is non-refundable. However, we understand that unforeseen circumstances may arise, and we will work with you to reschedule the session at the first mutually available date.
1.4. Payment Methods:
Payments should be made in South African Rand (ZAR) and can be made via (bank transfer, [EFT or cash]). (Please request when booking the session to receive the banking details for security purposes).
1.5. Additional disbursements:
Any additional costs incurred during the session, i.e. such as travel expenses, venue fees, extra photos, or other agreed-upon expenses, will be communicated to the and agreed upon between client and photographer, whereafter the additional costs will be added to the final invoice.
1.6. Late arrivals:
If the client or any other individual involved in the photography session arrives late, the session will still end at the originally scheduled timer, subject to an additional fee of R100 per hour or a proportional part thereof for the extended time to complete the session beyond the originally scheduled time.
The photographer reserves the right to amend these Terms and Conditions at anytime. Clients will be informed of any changes and will be subject to the Terms and Conditions in effect at the time of booking.
Late payments and failure to address outstanding invoices may result in the termination of our business relationship and a legal claim for the outstanding amount, together with legal costs and interest at the legally prescribed rate.
4.1. Our pricing for photography services is as follows:

-Session fee:
The client agrees to pay the Photographer the agreed-upon fees for the photography services provided. A written quote is provided for consideration and acceptance by the client.
-Additional mileage:
We charge R4 per km outside of the 10 km radius from my location on the day of the scheduled shoot.

-Extra Images:
R4 per extra image beyond those already included in the relevant package.
5.1. The copyright for the images produced during the session remain the sole property of AB Photography.
5.2. The client is granted a non-exclusive, non-transferable license to use the images for personal purposes only, including printing, sharing on social media, and displaying on personal websites or portfolios.
5.3. The client agrees not to edit, alter, or manipulate the images in any way without prior written consent from AB Photography.
5.4. AB Photography reserves the right to use the images for marketing, promotional materials, competitions, exhibitions, or other purposes related to the business, unless otherwise agreed upon in writing with the client.
6.1. We will make every reasonable effort to deliver the final images in a timely manner, typically within one week, However, this timeframe may vary depending on the volume of photos and any agreed-upon editing requests.
6.2. The client will receive the images in a digital format, either through an online gallery, or other agreed-upon method, such as Google Drive etc.
6.3. AB Photography is not responsible for the quality of prints ordered through third-party vendors.
7.1. AB Photography will take all necessary precautions to prevent loss, damage, or theft of equipment during the session. However, we are not liable for any personal injury, accidents, or damages caused to the client or their property during the session, or to any person or property attending the shoot through or under the client.
7.2. The client indemnifies and holds AB Photography harmless against any claims, losses, expenses, or liabilities arising from any event or the client's breach of these Terms and Conditions or any negligent act by the client before, during and after the shoot.
8.1. We may update these Terms & Conditions from time to time. The new Privacy Policy will be posted on this page. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective as and when they are posted on this page.

10.1. These Terms and Conditions shall be governed by and construed under the laws of South Africa.
10.2. Any disputes arising from these Terms and Conditions or the provision of our services shall be subject to the exclusive jurisdiction of the courts of South Africa.
11.1. The client warrants that all persons participating in the Project are aware of these Terms and Conditions insofar as it may concern them and that the client and the persons involved or their legal guardians if they are minors or under legal guardianship, have consented to the participation in the shoot and the creation of images. By using our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
